Terms of Service and Privacy Policy

I. Terms of Service (TOS) 
These Terms of Service (hereinafter "Terms") govern the use of the website www.meandny.com (hereinafter the "Site") and the online video editing/creation service offered within. The Site is owned and operated by Meandny (hereinafter "We," "Service," or "Platform").

2. Service Description and Order Process
2.1. Service Content
Our Service offers digital content processing, including:

Printing the Client's uploaded photo onto high-quality photo paper.
Creating a custom video by filming the printed photo at iconic New York City locations (e.g., Times Square).
Delivery of the final processed digital product (which may be a video or a photo).

2.2. Placing an Order
Orders are completed in stages, upon payment on the Site. The Client must follow these steps:

Product Selection: The Client selects the desired service based on the available product options on the Site.
Form Submission: The Client completes the order form, providing their name, surname, and contact information (email, phone).
File Upload: The Client uploads the necessary material (photo/video) for the Service to be performed.
Payment: Service provision commences only after full payment is received.
Delivery: The final product is delivered via a digital link. This link is valid for 7 days.

2.3. Content Restrictions and Disclaimer
The Meandny Platform disclaims any and all liability and reserves the right to refuse service and cancel an order if the photo or video content provided by the Client:

Fails to comply with the Platform's internal requirements and ethical standards.
Contains illegal, sexual, explicit, offensive, or other sensitive information/material that violates applicable international standards, public decency, and generally accepted ethical norms for digital content
In such cases, the refund policy is governed by Section 3.

3. Pricing, Payment, and Refund Policy
3.1. Payment and Timelines

Service fees are listed on the Site for each product description.
Payment is made electronically via the payment processor Stripe.
The standard service completion time is 2-3 Business Days , depending on the complexity of the order and the current workload.

3.2. Refunds

Cancellation Before Service Commences: The Client is entitled to a full refund if the editing or processing of the material has not yet begun.
Content Violation: If an order is cancelled due to a violation of the content restrictions outlined in Section 2.3, the order will be cancelled, and the funds will be returned to the Client.
Completed Service: If the service has been completed, the final file uploaded, and the result matches the promised requirements in the product description, no refund will be issued.

3.3. Weather and Force Majeure
Since the Service involves outdoor photography, completion times may be affected by extreme weather conditions (e.g., heavy rain, snowstorms, or official weather alerts). In such events, the 2-3 Business Day timeline will be temporarily suspended and will resume once conditions allow for safe and high-quality filming. The Client will be notified of any significant weather-related delays.

4. Intellectual Property

Client Material: The Client confirms they own the copyright or have the full right to provide and use the photo/video material uploaded for the Service. The Client grants Meandny a non-exclusive, transferable right to use the uploaded material strictly for the purpose of performing the ordered service.
Final Product: Upon completion of the service and delivery of the final product (video/photo), the copyright to the product is fully transferred to the Client.
Marketing Use: Meandny may use the finished product in its portfolio or promotional materials only upon the Client's prior written confirmation or consent.

II. Privacy Policy

5. Information Collection
We collect the following Personal Data: name, surname, email address, phone number, country, city, and automatically collected data (IP address).

Tracking Technologies: We use Cookies and tracking tools (Google Analytics, Facebook Pixel) for website usage analysis, site improvement, and marketing purposes.

6. Data Use and Retention

Purpose of Use: We use the data to fulfill orders, communicate with the Client, improve the Site, and measure advertising effectiveness.
Retention Period: Personal Data (name, email) is retained for one year for accounting purposes. Uploaded photos and final processed videos are retained on our servers for 30 days following order completion to allow the Client time to download the material. After 30 days, all media files are permanently deleted to ensure user privacy.
Sharing Data: Data is shared only with necessary third parties: Stripe (for payment processing) and Google/Facebook (for analytics and marketing).

7. User Rights
You have the right to request access to your data, rectification of inaccurate data, and deletion of your data ("Right to be Forgotten").
